Operator Terms

These Operator Terms are a legally binding agreement between you, the independent recovery operator or mobile mechanic ("you", "the operator"), and Dapper Trading LTD, trading as Recovr, registered in England and Wales (Company No. 8800299). They govern your use of the Recovr platform to receive and perform recovery work, and they appoint Recovr as your commercial agent for the bookings you accept. You accept these terms in the app before going online; your acceptance is recorded with its date, time and device.
1. Your status: an independent business
You are an independent business, not Recovr's employee, worker or subcontractor. You decide when to be online, which jobs to accept or decline (accepting or declining any individual job carries no sanction), what equipment and vehicles you use, and you may perform work for any other platform, customer or business at any time. Nothing in these terms creates employment, a partnership or a joint venture. You are the trader in every recovery contract formed through the platform, and consumer law, including the Consumer Rights Act 2015 duty to perform services with reasonable care and skill, applies to you accordingly.
2. Appointment of Recovr as your commercial agent
You appoint Recovr as your commercial agent, and Recovr accepts the appointment, solely to: (a) offer your services to customers through the platform; (b) CONCLUDE recovery contracts with customers in your name and on your behalf, at the price calculated and shown by the platform, on the terms of the customer-facing Terms of Use and Cancellation & Refunds Policy; (c) give customers the pre-contract information and contract confirmations that consumer law requires of you, on your behalf; and (d) COLLECT AND HOLD payment from customers for you, including cancellation fees. A customer who pays Recovr has discharged their debt to you. Recovr has no authority beyond this scope, and you have no authority to act for Recovr.
3. The contract you enter with each customer
When you accept a job, a contract for the recovery service forms directly between you and the customer at the moment of your acceptance, at the platform price you saw on the offer. You must honour that price and the Cancellation & Refunds Policy as terms of your contract with the customer: no on-site renegotiation, no cash side-deals, no charges beyond the platform price and the policies. The customer is identified to you on acceptance, and you are identified to them; your trading name and business address appear in their statutory booking confirmation.
4. Your obligations on every job
You must: perform the recovery with reasonable care and skill and within the law; attend within a reasonable time of accepting; keep your live location on during a job so the customer and the record are honest; verify arrival with the customer's code; treat customers with respect; and comply with consumer law in everything you do on the platform. You are responsible for your own driving, your own equipment, your own staff if you have them, and your own tax affairs, including VAT if you are or become VAT registered (tell us your VAT number in your profile so customer receipts are correct).
5. Insurance and licences (warranty)
You warrant, on every day you are online, that you hold valid: motor-trade road-risk insurance; public liability insurance; on-hook, goods-in-transit or equivalent cover where you transport customer vehicles; and every licence your activities require, including an operator's licence where your vehicles or activities fall outside the recovery-vehicle exemption. You will provide evidence on request and keep the documents you uploaded at verification current. Going online without this cover is a serious breach: it puts customers at risk and it is grounds for immediate suspension.
6. Money: collection, commission and payout
Recovr collects the customer's payment as your agent, holds it through our regulated payment provider, and remits your share to your connected payout account after settlement: 80% of the guaranteed pot on completed jobs, parts amounts in full, and 60% of any cancellation fee. Recovr retains the balance as its commission for the booking, dispatch, payment collection and platform services it provides you. Where you are VAT registered, amounts are handled consistently with your registration; Recovr's commission is inclusive of any VAT Recovr must account for. Recovr may set off refunds, price reductions and remedies lawfully due from you to a customer against amounts it holds or collects for you, and will always show you the ledger for your jobs.
7. Cancellation fees are your charge
The cancellation fee in the customer-facing policy is your charge for your loss when a customer cancels after you have committed: 50% of the call-out price while you are mobilising, and 100% once GPS shows you en route or arrived. Recovr assesses the step from the recorded GPS trail, collects the fee as your agent and pays you 60% of it. You must not charge customers any other cancellation amount or collect cancellation money directly.
8. Consumer complaints and remedies
Complaints about the recovery work are claims against you as the contracting trader. Recovr will administer them in good faith: we investigate on the platform record (GPS, chat, photos, timings), we put the substance to you before deciding anything, and where a remedy is lawfully due to the customer (re-performance, a price reduction, a refund) we may apply it from amounts held or collected for you. You must cooperate with investigations and with your insurers, and you indemnify Recovr against losses, claims and costs arising from your breach of these terms, your negligence, or consumer claims about your work, except to the extent caused by Recovr's own negligence or breach.
9. Data protection
Customer personal data shared with you for a job (name, contact number, location, vehicle) is provided for that job only. You are an independent controller of the records of work you perform; you must process customer data lawfully, keep it secure, use it for nothing beyond the job and your legal obligations, and delete what you do not need. Misusing customer data (marketing, sharing, off-platform contact soliciting) is a serious breach.
10. Suspension, termination and changes
You may stop using the platform at any time; amounts owed either way survive. Recovr may suspend or remove you for breach of these terms, invalid insurance or documents, safety concerns, fraud, or conduct harming customers or the marketplace, and may withhold pending payouts while a genuine investigation completes. We may update these terms with notice in the app; continuing to accept jobs after a change takes effect is acceptance. These terms are governed by the law of England and Wales.
